Employees who are members of the uniformed services, which include active duty members, reservists, National Guard members, past service members, and some individuals who are applicants for military service, are protected under the Uniformed Services Employment and Reemployment Rights Act (USERRA).

Reemployment Rights:

  • Employees who leave their jobs to perform military service are entitled to return to their civilian employment under the following conditions:

    • They must notify their employers of military service.

    • They must apply for reemployment within a specific timeframe based on the length of service (1 to 5 years).

    • They must not have been separated from service under dishonorable conditions.

  • Employees who are called to active duty are entitled to a continuation of health insurance benefits for themselves and their dependents.

  • Upon reemployment, employees are entitled to the same benefits they would have received had they not been absent due to military service.
