The Family and Medical Leave Act (FMLA) is a U.S. labor law that provides eligible employees with the right to take unpaid, job-protected leave for specified family and medical reasons.

Eligibility Requirements:

  • Must have worked for Nourish for at least 12 months

  • Must have at least 1,250 hours of service during the 12-month period immediately preceding the leave

  • Employees are required to provide 30 days’ notice when the need for leave is foreseeable. If the leave is not foreseeable, employees must provide notice as soon as possible.

FMLA Leave Entitlement (if eligible):

  • Up to 12 weeks of leave in a 12-month period for the following reasons:

    • The birth and care of a newborn

    • The adoption of fostering of a child

    • A serious health condition that prevents the employee from performing their job

    • The care of a spouse, child, or parent with serious health condition

  • Up to 26 weeks of leave in a single 12-month period to care for a covered service member with serious injury or illness

  • Job Protection: Employees who take FMLA are entitled to return to their same job or an equivalent job with the same salary, benefits, and working condition upon their return to work.

What is a serious health condition? A serious health condition is defined as an illness, injury, impairment, or physical or mental condition that involves:

  • Inpatient care in a hospital, hospice, or residential medical care facility

  • Continuing treatment by healthcare provider
